Terms of Use — SEAL (the "App")
Welcome to SEAL. These Terms of Use ("Terms") govern your access to and use of the SEAL mobile application and related services (collectively, the "Service") provided by seal ("we", "us", or "seal"). By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
- By creating an account, using the Service, or otherwise accessing content provided through the Service, you accept and agree to these Terms and any policies referenced herein.
- The Service is offered to individuals age 13 and older. The Service is not designed for children. If you are under the age required by applicable law to form a binding contract, you must not use the Service.
- Your continued use of the Service after we post changes to these Terms constitutes your acceptance of those changes as of the date posted.
2. Description of Service
- SEAL is an educational English language learning application available on iOS and Android. The Service uses spaced repetition techniques to help users retain vocabulary by allowing them to build a personalized "Vault" of words, scheduling reviews at optimized intervals, and providing progress analytics and gamification (including an evolving elephant mascot).
- Key features include:
- Vault creation and personalized review scheduling.
- Browser extension to capture words from web browsing and sync to the mobile app.
- Contextual sentences, definitions, and text-to-speech generated with Google Gemini AI and other text-to-speech technologies.
- Multi-device synchronization via Firebase (cloud_firestore, firebase_auth).
- Gamified progress tracking and streak rewards.
- Third-party services and technologies we use include: Google Generative AI (Google Gemini AI), Firebase (Cloud Firestore, Firebase Auth), Google Sign-In, Sign in with Apple, purchases_flutter for payments, and Firebase analytics and core. These third-party providers may impose additional terms; by using the Service you consent to those providers’ processing of data in accordance with their terms and privacy policies.
- The Service is provided as freemium: some features are free; additional features require a paid subscription.
3. User Accounts & Registration
- Account creation: To use certain features you must register an account and provide accurate, current, and complete information (including name and email). You agree to keep your account information up to date.
- Authentication: You may register using email/password, Google Sign-In, or Sign in with Apple. We use Firebase Authentication to manage user authentication.
- Account security: You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at seal@forvibe.app if you suspect unauthorized use of your account.
- Profile data: You may add a profile photo and other optional profile information. You retain ownership of your user-generated content, subject to the license you grant in Section 5.
- Multi-device sync: Your account data is synchronized across devices using cloud services (e.g., Cloud Firestore). We do not guarantee uninterrupted sync and are not responsible for temporary data inconsistencies.
4. User Obligations & Acceptable Use
- You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not:
- Use the Service to upload, transmit, or store illegal, infringing, harmful, threatening, abusive, defamatory, or otherwise objectionable content.
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of the Service.
- Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
- Attempt to access other users’ accounts, data, or private areas of the Service.
- Use automated means (bots, scrapers, crawlers) to access or collect data from the Service except where explicitly authorized (e.g., official browser extension).
- Remove, obscure, or alter any proprietary notices on the Service.
- Browser extension: If you install and use our browser extension to capture words, you must comply with the extension’s terms and any applicable browser store policies. Do not use the extension to capture content you do not have the right to use.
- AI content: The Service uses Google Gemini AI and other AI services to generate contextual sentences, definitions, and other learning content. AI-generated content may sometimes be inaccurate, incomplete, or biased. You agree not to rely solely on AI-generated content for critical decisions. See Section 6 for more on disclaimers.
- Cooperation: You agree to cooperate with seal in investigating suspected violations of these Terms and to provide information reasonably requested.
5. Intellectual Property Rights
- Our rights: All intellectual property rights in and to the Service, including the app design, user interface, graphics, trademarks, logos, and the non-user-generated content, are owned by seal or our licensors. These Terms do not transfer any ownership rights to you.
- License to use the Service: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on compatible devices for your personal, non-commercial use.
- User content:
- You retain ownership of the content you submit to the Service (e.g., words added to your Vault, notes, profile data).
- By submitting user content, you grant seal a worldwide, royalty-free, non-exclusive, sublicensable, transferable license to use, host, store, copy, modify, reproduce, distribute, prepare derivative works of, display, and perform such content as reasonably necessary to provide and improve the Service, to sync across devices, to generate AI-assisted content, and to provide analytics. This license ends when you delete your content from the Service, except where retention is required by law or for backups.
- AI-generated content: Content generated by Google Gemini AI or other third-party AI services through the Service is provided to you for your use. To the extent required, you grant seal any rights necessary to obtain and deliver AI-generated outputs to you; seal's use of AI services is subject to those third parties' terms.
- Trademark notice: The names and logos of seal and SEAL are trademarks of seal. You may not use our trademarks without express written permission.
6. Disclaimers & Limitation of Liability
- Disclaimers:
- THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, seal DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- AI AND CONTENT ACCURACY: WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF INFORMATION PROVIDED BY AI SERVICES (E.G., GOOGLE GEMINI AI) OR BY ANY USER. SUCH CONTENT MAY CONTAIN ERRORS OR INACCURACIES.
- NO GUARANTEE OF LEARNING: THE SERVICE USES SPACED REPETITION TECHNIQUES AND OTHER TOOLS TO ASSIST LEARNING, BUT WE DO NOT GUARANTEE SPECIFIC LEARNING OUTCOMES OR RESULTS.
- AVAILABILITY: WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
- Limitation of Liability:
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL seal, ITS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR USE) ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE;
- DAMAGES ARISING FROM THIRD-PARTY SERVICES OR CONTENT;
- DAMAGES RELATING TO AI-GENERATED ERRORS.
- THE TOTAL AGGREGATE LIABILITY OF seal FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO seal FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY. IF YOU HAVE NOT PAID seal ANY AMOUNTS DURING THAT PERIOD, THE TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED USD $50.
- Some jurisdictions do not allow exclusion or limitation of certain warranties or liabilities; in such jurisdictions, liability is limited to the fullest extent permitted by law.

7. Subscriptions & Payments
- Freemium model: The Service offers free features and paid subscription tiers that unlock premium features (e.g., advanced review scheduling, additional AI-generated content, enhanced analytics).
- Subscription terms:
- Subscriptions typically renew automatically until canceled. By subscribing, you authorize recurring charges to your payment method, and you agree to any trial-to-paid conversion terms disclosed at purchase.
- Payments are processed via purchases_flutter and the respective app stores (Apple App Store for iOS and Google Play for Android). Your purchase is subject to the terms of the app store through which you bought the subscription.
- You must cancel through the app store subscription management settings to prevent automatic renewal. We are unable to cancel subscriptions for you, except as required by applicable law.
- Billing and refunds:
- Billing cycles, pricing, and cancellation policies are displayed at the point of purchase. Unless otherwise stated, subscriptions are billed in advance and are non-refundable, except as required by law or at our sole discretion.
- If your subscription includes a free trial and you do not cancel before the trial ends, you will be charged for the subscription at the then-current rate.
- Price changes: We may change subscription prices and will provide notice of material changes before they take effect. Price changes do not affect subscriptions already paid for, but renewal rates may change after the current term ends.
- Account suspension for non-payment: We reserve the right to suspend or terminate access to paid features if payment obligations are not met.
8. Termination
- Termination by you: You may stop using the Service at any time and may delete your account through the app or by contacting seal@forvibe.app. Deleting your account will remove your Vault and user data, subject to any legal retention obligations.
- Termination by seal: We may suspend or terminate your access to the Service, with or without notice, for any reason, including violation of these Terms, suspected fraud, security concerns, or request by law enforcement.
- Effect of termination:
- Upon termination, your license to use the Service ends, and we may delete your account data. Any amounts owed to seal prior to termination remain due.
- Sections that by their nature should survive termination (e.g., Intellectual Property Rights, Disclaimers & Limitation of Liability, Governing Law, and Changes to Terms) shall survive.
9. Governing Law
- These Terms and any disputes arising out of or relating to them or the Service are governed by the laws of the State of California, United States, without regard to its conflict-of-law principles.
- You agree that the exclusive jurisdiction and venue for any disputes not subject to arbitration (if any) will be the state or federal courts located in Santa Clara County, California.
10. Changes to Terms
- We may modify these Terms from time to time. When we make material changes, we will provide notice via the Service, email (if we have your email), or by posting the updated Terms with a new "Last Updated" date.
- Your continued use of the Service after the effective date of a revised version constitutes acceptance of the revised Terms.
- If you do not agree to the updated Terms, you should stop using the Service and may delete your account.

Additional Notices
- Third-Party Services and Data Processing: The Service integrates third-party services (listed in Section 2). By using the Service, you consent to the transfer, processing, and storage of your information by these third-party providers in accordance with their terms. If you have questions about how third parties process your data, please consult their privacy policies.
- No Advertising: The Service currently does not display third-party advertising.
- Export Controls: You agree to comply with all applicable export laws and regulations governing use of the Service and will not export or re-export any technology or software from the Service in violation of such laws.
By using SEAL, you acknowledge that you have read, understood, and agree to be bound by these Terms.
